RELEASE OF LIABILITY

READ CAREFULLY - THIS AFFECTS YOUR LEGAL RIGHTS
In exchange for participation in the activities at and/or organized by Thrive Yoga Studios and/or for use of the property facilities, and services of Thrive Yoga Studios , I agree, for myself and (if applicable) for the members of my family, to the following:
  1. AGREEMENT TO FOLLOW DIRECTIONS & REPRESENTATION OF PHYSICAL HEALTH. I agree to observe and obey all posted rules and warnings, and further agree to follow any oral instructions or directions given by Thrive Yoga Studios, or the employees, representatives, or agents of Thrive Yoga Studios. I further represent and warrant that I and (if applicable) my family members are in good physical health and do not suffer from any medical condition which would limit participation in the activities at and/or organized by Thrive Yoga Studios.
  2. ASSUMPTION OF THE RISKS AND RELEASE. I recognize that there are certain inherent risks associated with the activities at and/or organized by Thrive Yoga Studios, and/or by the use of the property, facilities, and services of Thrive Yoga Studios, and I assume full responsibility for any and all injuries to myself and (if applicable) my family members, and further release and discharge Thrive Yoga Studios for any and all injuries, losses, or damages arising out of my or my family's use of or participation in the activities at and/or organized by Thrive Yoga Studios and/or for the use of the property, facilities, and services of Thrive Yoga Studios, whether caused by the fault of myself, my family, Thrive Yoga Studios(including its employees, representatives, agents, invitees, or licensees), or other third parties.
  3. INDEMNIFICATION. I agree to defend, indemnify and hold Thrive Yoga Studios harmless against any and all claims, causes of action, damages, judgments, costs or expenses, including attorney fees and other litigation costs, which may in any way arise from my or my family's use of or presence upon the facilities of Thrive Yoga Studios.
  4. DAMAGES. I agree to pay for all damages to the facilities of Thrive Yoga Studios are caused by any negligent, reckless, willful, or intentional actions of me or my family.
  5. APPLICABLE LAW. Any legal or equitable claim that may arise from this Agreement shall be resolved pursuant to Colorado law.
  6. NO DURESS. I agree and acknowledge that I am under no pressure or duress to sign this Agreement and that I have been given a reasonable opportunity to review it before signing. I further agree and acknowledge that I am free to have my own legal counsel review this Agreement if I so desire. I further agree and acknowledge that Thrive Yoga Studios has offered to refund any fees I have paid to use its facilities if I choose not to sign this Agreement.
  7. ENFORCEABILITY. The invalidity or unenforceability of any provision of this
Agreement, whether standing alone or as applied to a particular occurrence or circumstance, shall not affect the validity or enforceability of any other provision of this Agreement or of any other applications of such provision, as the case may be, and such invalid or unenforceable provision shall be deemed not to be a part of this Agreement.
I agree to inform the instructor of specific ailments, injuries and conditions.
I understand there is an inherent risk associated with any exercise program including my voluntary participation in yoga and physical fitness activities that may result in injury.
I acknowledge that I have had a physical examination and have been given permission from my physician to participate in a yoga based exercise program. I certify that I am physically well and suffering from no medical problems that would prevent my participation in a fitness-based program.
I waive and release Thrive Yoga Studios. from any and all liability and responsibility from injury or accident while participating in their yoga program.
I HAVE READ THIS DOCUMENT AND UNDERSTAND IT.
I FURTHER UNDERSTAND THAT BY SIGNING THIS AGREEMENT, I VOLUNTARILY SURRENDER CERTAIN LEGAL RIGHTS.
